Here Are Some Clarifications About Expert Testimony:
Expert testimony is only permissible if a witness is qualified as an expert by knowledge, skill, experience, training, or education. Expert witness and expert testimony are terms used interchangeably.
The expert witness must meet 4 requirements:
(1) The expert witness’ scientific, technical, or other specialized knowledge will help the trier of fact understand the evidence
(2) There is sufficient data for the testimony
(3) There are are reliable principles and methods for the testimony
(4) The expert witness has reliably applied the principles and methods to the facts of the case.
Expert witnesses may testify in the form of an opinion. An expert witness may testify generally about principles, methods, or other information and leave the ultimate inference to the trier of fact.
